Debt... it's a word that all Americans are familiar with, but for most Americans, it is a word they are personally familiar with.  Statistics show that Americans, on average, carry almost $6,000 in credit card debt from month to month.  Because a large part of the population (40% of US families), spend more money than they earn, they are only making minimum payments on their credit card.  With making minimum payments on a balance of $6,000, it would take 30 years to pay off the balance, not to mention adding almost $15,000 in interest.

Debt Collectors

A debt collector is categorized as any person who regularly collects debts owed to others.  Though their main job is to collect debts, they do have to follow detailed rules and regulations regarding how and when they contact you.  For example, a debt collector may contact you in person, by mail, by telephone, by telegram, or by fax, but they may not contact you before 8:00am or after 9:00pm.

Prohibited Debt Collection Practices

Harassment.  A debt collector may not harass, oppress, or abuse you or any third parties they contact.  For example, they may not:

  • use threats of violence or harm
  • publish a list of consumers who refuse to pay their debts (except to a credit bureau)
  • use obscene or profane language; or repeatedly use the telephone to annoy someone

False Statements.  A debt collector may not use any false or misleading statements when collecting a debt.  For example, they may not:

  • falsely imply that they are attorneys or government representatives
  • falsely imply that you have committed a crime
  • falsely represent that they operate or work for a credit bureau
  • misrepresent the amount of your debt
  • indicate that papers being sent to you are legal forms when they are not
  • indicate that papers being sent to you are not legal forms when they are
